Service Provider
These Terms and Conditions govern the relationship between Fluensys (trading name of Marquez Williams, registered autónomo, Spain) and any person who registers for, purchases, or participates in a Fluensys programme or service.

Scope of Application
These terms apply to all services offered by Fluensys including, but not limited to:
- Fluensys Pro — exam preparation programmes for adults and university candidates
- Fluensys Academic — curriculum-aligned Cambridge preparation for school-age students
- Fluensys English — ongoing general English programmes
- Fluensys Summer Bootcamp — intensive exam preparation programmes
- Fluensys Diagnostic — intake assessment and proficiency profiling services
Each programme may be accompanied by a specific Programme Enrolment Agreement which supplements these Terms. In the event of any conflict, the Programme Enrolment Agreement takes precedence for the matters it covers.
Services Offered
Fluensys provides English language education and examination preparation services delivered online. All sessions are conducted live via video conference unless otherwise stated.
Fluensys does not guarantee any specific examination result or score. Programme design is based on evidence-based preparation methodology, but outcomes depend on individual student effort, attendance, and prior level.
External examination registration, fees, and results are the responsibility of the relevant examination board (Cambridge Assessment English, British Council, IDP, or equivalent). Where Fluensys offers examination registration support, this is an administrative facilitation and does not constitute a guarantee of entry or acceptance.
Registration and Enrolment
Registration for any Fluensys programme constitutes an offer to enter into a service agreement. Enrolment is confirmed only upon receipt of the applicable deposit or full payment, as specified for each programme.
Fluensys reserves the right to decline or defer a registration if the student's assessed level is not appropriate for the selected programme. In such cases, any payment received will be refunded in full or applied to a more suitable programme at the student's election.
For programmes requiring an intake diagnostic, completion of the diagnostic is a condition of final placement. Failure to complete the diagnostic within the specified window may result in forfeiture of the reserved place without refund of the deposit.
Pricing and Payment
All prices are displayed in Euros (€) and are inclusive of any applicable Spanish IVA where required by law. Payment is processed via Stripe. Fluensys does not store card details.
Where a deposit structure applies, the deposit secures the place and the remaining balance is due by the date specified at registration. Failure to pay the balance by the due date may result in forfeiture of the deposit and cancellation of the reserved place.
Prices are subject to change. The price applicable to a given enrolment is the price confirmed at the time of registration and deposit payment.
Examination registration fees (including Cambridge exam fees of approximately €205) are not included in programme fees unless explicitly stated. These are paid by the student directly to the examination board, or reimbursed to Fluensys where Fluensys has facilitated the registration on the student's behalf.
Cancellation and Refunds
Student-initiated cancellation
A student may cancel their enrolment and request a refund subject to the following conditions:
- Before programme start: Full refund of any amount paid, minus any diagnostic or materials costs already incurred by Fluensys.
- During Week 1 of the programme: Partial refund calculated as the total amount paid minus the pro-rata cost of sessions attended and any materials provided. The refund window closes at the end of the first calendar week of the programme.
- After the end of Week 1: No refund is available. The programme fee is non-refundable from this point forward.
Bootcamp programmes: Given the compressed four-week format, the refund window closes at the end of Day 5 (Friday of Week 1). No refunds are issued after this date under any circumstances.
Fluensys-initiated cancellation
If Fluensys cancels a programme before it begins, a full refund of all amounts paid will be issued within 14 days. If Fluensys cancels a programme after it has commenced, a pro-rata refund for the remaining sessions will be issued.
Requesting a refund
Refund requests must be submitted in writing to hello@fluensys.es within the applicable window. Refunds are processed via the original payment method within 14 days of the approved request.
Consumer rights
Where a student qualifies as a consumer under Spanish consumer law (Real Decreto Legislativo 1/2007), the statutory 14-day right of withdrawal applies to distance contracts. This right begins on the date of contract conclusion. Where the student has explicitly requested that the service begin within this period, the withdrawal right is forfeited on a pro-rata basis for services already delivered.
Programme Delivery
Attendance
Students are responsible for attending all scheduled sessions. Fluensys does not offer make-up sessions for missed classes in group programmes. A missed session is a missed session — it cannot be rescheduled, replayed, or substituted. Students are encouraged to notify Fluensys in advance of any known absence, but notification does not entitle the student to a replacement session or refund.
Technical requirements
Students are responsible for ensuring they have a stable internet connection, a device with a working camera and microphone, and a suitable environment for live sessions. Technical failures on the student's side do not entitle the student to a replacement session.
Modifications to programme content
Fluensys reserves the right to modify session content, structure, or scheduling where reasonably necessary. Material changes that affect the core nature of the programme will be communicated to enrolled students in advance.
Code of conduct
Students are expected to engage respectfully and constructively in all sessions. Fluensys reserves the right to remove a student from a programme without refund in cases of persistent disruptive behaviour.
Intellectual Property
All materials provided by Fluensys — including session content, written feedback, error correction frameworks, diagnostic reports, and written resources — are the intellectual property of Fluensys and are licensed to the student for personal use only.
Materials may not be reproduced, shared, sold, or distributed without prior written consent from Fluensys. This applies to both physical and digital materials.
The Fluensys brand, name, logotype, and proprietary methodology are protected. Unauthorised commercial use is prohibited.
Limitation of Liability
Fluensys shall not be liable for any indirect, incidental, or consequential loss arising from participation in or inability to participate in a programme, including but not limited to examination failure, missed examination windows, or loss of professional opportunity.
Fluensys's total liability to any student in connection with a programme is limited to the amount paid by that student for the programme in question.
Nothing in these Terms excludes liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation.
Data Protection
Fluensys processes personal data in accordance with the Fluensys Privacy Policy and applicable Spanish and European data protection law (GDPR / LOPDGDD). By registering for a programme, students consent to the processing of their personal data as described in the Privacy Policy.
For diagnostic and assessment purposes, voice recordings and written submissions are stored securely for instructor review. These are not shared with third parties and are retained only for the duration necessary to deliver the service.
Governing Law and Jurisdiction
These Terms and Conditions are governed by the laws of Spain. Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Barcelona, Spain, except where mandatory consumer protection law in the student's country of residence provides otherwise.
